Delivery Terms & Conditions
These are our terms and conditions. Please read them carefully.
1. You Agree that:
- By using the Hunter Organic Foods website for the purchase of our goods and services you agree to accept our Terms and Conditions of use.
2. Payment Terms
- Payment for your first delivery is due prior to delivery.
- Payment for one-off or irregular orders will also be required prior to delivery (unless otherwise organised) eg payment on pick-up if opting to pick up in-store.
- Payment can be made via the online credit card facility upon checkout on our website.
- Payment for regular subscribers (VIP Members) will be processed at 3pm the day after delivery. VIP members agree to store their credit card details with Squareup (our Merchant facility) to facilitate efficient processing of payments. Please contact us to make other arrangements.
3. Pricing & Weights
- Set Boxes are a set price and the weight and quantity of produce varies time to time. We update the list weekly and the contents, amounts and weights listed are subject to change. These are given as an indication only as weights and amounts may vary according to market prices and availability.
- Pick Your Own fruit and vegetable prices are regularly updated and all of our fresh produce that we offer are subject to variations in seasonal availability and supply price. Some items are sold by a minimum weight (ie. 500g bag) or as an individual unit. Sizes of organic produce can vary so when buying by the weight, we endeavour to weigh as accurately as possible, however this can vary from time to time.
- Hunter Organic Foods reserves the right to alter pricing or introduce new minimum spend conditions which will be published on our website.
4. Subscription Orders (VIP Members)
- Setting up a Subscription Order is free.
- Subscription orders are for Weekly or Fortnightly deliveries.
- You acknowledge that your Subscription Order has a recurring payment and you accept responsibility for all recurring charges.
- You are agreeing to an indefinite period until cancelled by you either via your account on our website or by notifying us via email or phone.
- You can Suspend your order and payment for a period or for one time. You can manage order suspensions either via your account on our website or by notifying us by email or phone.
- You agree to notify us by email or phone to re-activate your Subscription if you have suspended it for more than 2 weeks.
- Any Cancellations or Suspensions to your order must be made before the order cut off time of your delivery day, by phone or email. Please refer to the Order Cut Off Times below.
- A $10 cancellation fee may be charged to your account if your order is cancelled or suspended after the Order Cut Off Times.
- An additional $10 will be applied for orders cancelled after order has been packed and on the road for delivery.
- We reserve the right to refuse deliveries to you and to cancel your account where payment(s) have been withheld. You agree to compensate us in full for all reasonable costs and expenses (including legal costs) in obtaining payments that have not been made in accordance with these terms and conditions.
- Fruit and vegetable prices are regularly updated and all of our fresh produce that we offer is subject to variations in seasonal availability and supply price. Pricing for a product or products can change over time from when you first set up your subscription order.
- You must promptly advise us of any payment details that need to be updated, either by phone or email.
- Payment will be debited the day after delivery. Any claims for missing, spoilt or damaged items should be made by 9am the day after delivery.
- If your payment is rejected or declined, your Subscription Order may be cancelled. In this case, please contact us promptly so we can re-instate your Subscription Order.
- Please ensure you read the following Terms & Conditions as some also apply to Subscription Orders.
5. Order Cut-Off Times
(A) Subscription Orders
- Cut-Off time for cancellation or suspension of Tuesday subscription orders is 3pm Sunday
- Cut-Off time for additions to a Tuesday subscription order is 3pm Monday
- Cut-Off time for cancellation or suspension of Friday subscription orders is 3pm Wednesday
- Cut-Off time for additions to a Friday subscription order is 3pm Thursday
(B) First-Time Orders and One-Off Orders
- For a Tuesday delivery, Cut-Off times for first-time orders and one-off orders is 12pm Monday
- For a Friday delivery, Cut-Off times for first-time orders and one-off orders is 12pm Thursday
5. Order Cancellations (for Subscription orders)
- A cancellation fee of $10 applies for orders cancelled after the order cut off time.
- An additional $10 will be applied for orders cancelled after order has been packed and on the road for delivery.
6. Delivery, Handling Charges and Taxes
- We only deliver within 12km radius of our shop in The Junction 2291.
- There is no charge for your first delivery where your order is $65 or more
- There is no charge for any subsequent delivery where (a) you are a VIP member and your order is $50 or more or (b) for all other deliveries where your order is $100 or more.
- Where these minimum order thresholds are not meet a delivery fee of $7.50 (inc GST) will be charged.
7. Delivery Conditions
- To purchase groceries from Hunter Organic Foods, the delivery address which you nominate will need to be within a suburb where Hunter Organic Foods provides delivery services. Orders for delivery to addresses in suburbs that are not in the delivery area will not be processed.
- Delivery times and arrival of your order will depend on your area and day. You will be notified of your estimated delivery time via email when you make your first order. Your delivery day and time is subject to change.
- We do not deliver on Public Holidays and an alternative delivery day will be provided.
- You must make all appropriate arrangements to assist and allow us to deliver your order, including obtaining any prior security, or other approvals which may apply to your delivery location.
- In the event of delivery delays beyond our reasonable control, we will endeavour to provide you with notice of the delay as soon as reasonably possible. We will not be liable to you or any other person for any such delay.
8. Unattended deliveries
- Hunter Organic Foods cannot be held responsible for any unforeseen damage or theft to your order when left in the designated area as specified by you. We recommend that your delivery is brought inside and stored correctly as soon as possible.
9. Credits, Refunds & Substitutions Policy
- Hunter Organic Foods aims for 100% customer satisfaction. If you are unhappy with a product or our service we will exchange or credit the value of the item. Please notify us within 12 hours from time of delivery as we may not refund after this time has passed.
- Hunter Organic Foods accepts that in the event of goods arriving damaged, we will replace the goods free of charge or a credit or refund will be issued.
- To make a return, please inform us either by email or phone.
- Our produce and products are subject to availability and we do not always know if a product is, or will be available for delivery at the time of accepting an order. If we are unable to deliver an item you have ordered we may offer a reasonable substitute.
- If we are unable to offer a reasonable substitute of a product already purchased by you, a credit to your account will be applied, or you will be refunded. Please allow 5 working days for refunds to be processed.
10. Refrigerated Products
- Hunter Organic Foods provides refrigerated items, which at the time of delivery will be at a temperature in accordance with Food Health and Safety standards.
- If you are not home at the time of delivery it is highly recommended that customers provide a cooler bag along with cooler gel packs or ice sheets (recommend 1 sheet per carton of milk).
- Upon delivery, if the customer is not home, refrigerated products will be left together with the total order AT THE CUSTOMERS RISK
- Hunter Organic Foods DOES NOT TAKE RESPONSIBILITY for spoiled refrigerated products.
